Legal BIM news: the Basque Authority for Procurement Contractual Remedies in Spain decided that the requirement in the tender documentation to use #BIM technology as contract performance condition was legal!
In brief, it was ruled that: (i) since the entry into force of Directive 2014/24/EU , there was sufficient time for all actors on the market to adapt to the new technology; (ii) the condition to use BIM technology is in the public interest, (iii) the BIM technology is already considered a generally used technology.
