We advised a construction company in relation to the Vidraru Dam modernization tender, an 80 EUR million worth tender  organized by HIDROELECTRICA SA

We advised an international construction company during one of the largest public tender exercises in Romania on the construction of a gas pipeline. It was organized by TRANSGAZ SA. We supported our clients in the review of their contracts and risk assessment. We drafted requests for clarifications and provided general legal assistance on the Romanian regulatory framework.

We successfully worked with an international piping manufacturer during one of the largest public tender exercises in the European gas sector for the Development of the National Gas Transmission System – the BRUA Pipeline. The tender had a total value of 200 million Euros and was organized by TRANSGAZ SA. With our support, our client was able to submit a tender.

We successfully assisted and represented a major Spanish company in a procurement dispute related to  a  EUR 300 million tender  for the purchase of railway equipment. . The   contracting authority was the Romanian Railway Authority (Autoritatea pentru Reforma Feroviara. We  secured the modification of the selection criteria pursuant to a successful claim brought before the CNSC. With our support, our client was able to comply with the set requirements for  submitting an offer.

We assisted and represented two construction companies with procurement claims  in respect with a tender procedure for a new water treatment plant and works being carried out within another. The  EUR 30 million project was organized by RAJA CONSTANTA. We established a defense strategy for the clarification of the requirements related to the execution of works for a discharge pipeline within the sea and we developed legal and technical arguments in relation to the pipejacking techniques applicable to the set requirements based on CJEU case law on the legality of award criteria.

We assisted and represented a Spanish contractor in a dispute against TRANSELECTRICA SA which arose during a tender procedure for the construction of a 63 million Euro  power plant. We developed a defense strategy based on EU and national legal arguments, particularly CJEU case law. We developed matters ranging from third party capabilities reliance, reliability of economic operators, confidentiality of tenders, standing and justiciability as well as conditions on payment of bonds

We assisted and represented a construction company in a claim for annulment in relation to an important tender for works on the sewage system and water treatment in Brasov County.  The contracting authority was Compania Apa Brasov. We developed a defense strategy against the rejection of our client’s offer based on the price breakdown requirements of the contracting authority

We assisted one of the largest specialized textile in a defense procurement procedure. Our assistance included legal advice on domestic and EU defense procurement regulations, risk assessment, contract interpretation, drafting of request for clarifications, and assistance during the bids opening session. As a result of our input, our client was successfully awarded the contract.

We assisted a large, Spanish construction company in over 15 tender procedures in Romania. These included highway construction, rehabilitation and extensions of sewage systems across Romania, large and medium sized water treatment plants, wastewater pump stations rehabilitation. Our work with the client included FIDIC-based vs. national standard contract analysis and risk assessments for each of the tenders, contract interpretation, and descriptions and explanations on the applicable regulatory framework, including on issues such as guarantees and insurance as well as procurement remedies.

We represented a major, international company in an expropriation procedure. We successfully secured avoidance of the expropriation of the client´s main assets. Additionally, we obtained a technical modification of a highway project to ensure that the functionality of our client’s factory would  not be affected. Our support included an administrative dispute against the government as well as multiple negotiations and meetings with the expropriator, the contractor, and the client.

We assisted an international consortium made of Italian, Chinese and Bulgarian manufacturers in a tender procedure for the acquisition of electric buses. Our work included regulatory risk assessment, as well as advice with requests for clarifications. We secured a flexible interpretation of the selection criteria from the part of the contracting authority through motivated requests for clarifications.

We represented an international renewable energy company in an administrative dispute in Romania against the refusal of the public energy regulator to issue a required permit for our client´s access to the green certificate scheme.

We assisted a real estate developer during the due diligence process in acquiring a large property located in the center of Bucharest. As a result of our work, our client acquired the land for the development of a high-stake residential and office development project. We assisted the client during with the drafting and negotiating of the Sale Purchase Agreement, and effectively assisted the client before various entities, inter alia banks, notary and public administration.

We assisted in the sale and purchase agreements of land located in Bucharest. The property belonged to an important real estate investors group valued at over 5 million Euros.

We provided support for various contractors and subcontractors with the implementation of multiple contracts for highway construction as well as dispute management in projects for highways, railways and water projects.

We have provided advice and assistance on the Romanian National Standard Contract applicable to all general public construction works with values over the prescribed threshold.
